Chapter VII – Traffic
and Motor Vehicles
Section 701.071A -
Parking of Commercial Vehicles in the City of
Purpose. The purpose of this section is to regulate the parking of certain
commercial vehicles in the city to protect the health, safety and welfare of
the citizens of the City of
Subdivision 1. For the purposes of this section the terms
defined in this subsection have the meaning given them.
Subd.
2. “Truck-tractor” shall mean that term as defined in Minnesota State Statutes
Chapter 168.011, subd. 12, or as hereafter amended.
Subd. 3. “Semi-trailer” shall mean
that term as defined in Minnesota State Statute Chapter 168.011, subd. 14, or
as hereafter amended.
Parking Prohibited. It shall be unlawful for any person,
business, or other entity to park a truck-tractor or semi-trailer on public
property.
Exceptions: Truck-tractors and/or semi-trailers which are
actively engaged in loading, unloading, or providing a service; truck-tractors
and/or semi trailers associated with public or private construction and parked
within 500 feet of the construction location.
Section 701.071B -
Parking of Recreational Vehicles in the City of
Purpose. The purpose of this section is to regulate the parking of certain
recreational vehicles in the city to protect the health, safety and welfare of
the citizens of the City of Askov, and to preserve the residential character of
the areas zoned as such.
Definitions. Subdivision 1. For the
purposes of this section the terms defined in this subsection have the meaning
given them.
Subd. 2. “Recreation Vehicle” shall mean that term as
defined in Minnesota State Statutes Section 18.011, subd. 25, or as hereafter
amended.
Parking Prohibited. It shall be unlawful for any personal,
business, or other entity to park a recreation vehicle on public property, with
the exception of the City’s RV park, for a continuous period in excess of
forty-eight (48) hours.
Section 701.071C -
Parked Vehicles Impounded
Purpose. A vehicle in violation of sections
one and two may be ordered removed from a public street, boulevard, ditch, and
right-of-way by a law enforcement officer. The vehicle may be towed away to a garage, service station or other
place of safekeeping as soon as possible. The vehicle will be surrendered to the duly identified owner or its
representative upon payment of the towing and storage fees. Removal of the vehicle does not bar
prosecution for a violation of this section.

Penalties
Purpose. Any person violating this ordinance is guilty of a petty misdemeanor
punishable by a maximum fine as set by
Violations
of this ordinance may be charged, at the option of the City of Askov, as
misdemeanor offenses if the following conditions or situations are proven to
exist: (a) the person charged with a violation of this ordinance has been
convicted of this ordinance at least twice within the preceding 12-month period
of time; (b) the violation of this ordinance was committed in a manner or under
circumstances to as to endanger or be likely to endanger any person or
property.
Under
the present provisions of
Effective
Date
This
ordinance shall take effect and be in force after its passage and publication
according to law.
